End-User License Agreement (EULA) for QubeeQ App

This End-User License Agreement ("EULA") is a binding legal agreement between you, the end-user ("Licensee" or "You"), and Qubeeq.org ("Licensor," "We," "Us," or "Our") for the use of the QubeeQ mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms of this EULA, you may not download, install, access, or use the App.

1. License Grant

Qubeeq.org hereby grants You a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this EULA.

2. Age Restriction

You affirm that you are at least 18 years of age. The App is not intended for use by anyone under the age of 18. If you are under 18, you may not use or access the App. If you are below 18 years of age, you must have your parent or legal guardian's permission to use the App, and your parent or legal guardian must agree to this EULA on your behalf.

3. User-Generated Content (UGC) Policy

The QubeeQ App allows users to create, upload, post, send, receive, and store content, including messages, photos, videos, or other materials ("User-Generated Content" or "UGC"). Qubeeq.org is committed to fostering a safe, respectful, and compliant environment for all users.

3.1 No Tolerance for Objectionable Content or Abusive Users

Qubeeq.org has a strict zero-tolerance policy for objectionable content, abusive behavior, and any content or conduct that violates applicable laws, this EULA, or our community guidelines. Objectionable content includes, but is not limited to, content that is defamatory, discriminatory, harassing, threatening, sexually explicit, violent, illegal, or promotes hate speech. Abusive users are those who engage in such objectionable behavior or repeatedly violate our policies.

3.2 User Responsibilities

You are solely responsible for the UGC you create, upload, post, or transmit through the App. You agree not to post, upload, transmit, distribute, store, create, or otherwise publish through the App any UGC that:

• Is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable.
• Would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, state, national, or international law.
• May infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party.
• Impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity.
• Contains unsolicited promotions, political campaigning, advertising, or solicitations (spam).
• Is designed to manipulate or interfere with the App, including introducing viruses, corrupted data, or other harmful, disruptive, or destructive files.

3.3 License Grant by User for UGC

By posting, uploading, or transmitting any UGC to the App, you hereby grant Qubeeq.org a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such UGC... 3.4 Disclaimer of Responsibility for UGC

Qubeeq.org acts as a passive conduit for the distribution of UGC and is not responsible or liable for any UGC posted by users or any third party...

3.5 Content Moderation and Enforcement

• Filtering Objectionable Content: We employ a combination of automated and manual methods...
• Flagging Mechanism: Users are provided with a mechanism within the App to report content...
• Blocking Abusive Users: Users can block others they do not wish to interact with...
• Developer Action: Qubeeq.org will act within 24 hours on credible reports...
• Copyright Infringement (DMCA Policy): If you believe any UGC infringes your copyright...

4. Restrictions

You agree not to, and You will not permit others to:

• License, sell, rent, lease, assign, distribute...
• Modify, reverse engineer, or attempt to derive source code...
• Remove or alter any proprietary notices...
• Use the App for any illegal or unauthorized purpose...
• Engage in automated use of the App...
• Impersonate another user or person...

5. Intellectual Property

The App and all associated intellectual property belong to Qubeeq.org...

6. Privacy Policy

By using the App, You agree to our Privacy Policy...

7. Third-Party Websites and Content

The App may link to external sites we don’t control...

8. Modifications to the App and Services

We reserve the right to modify, suspend, or discontinue the App at any time...

9. Termination

This EULA will remain in effect until terminated by You or Qubeeq.org...
